Terms & Conditions — Fly Club
Owner/operator: Fly Club (“Fly Club,” “we,” “us,” “our”)
These Terms & Conditions form a binding agreement between you and Fly Club. By accessing or using the Service, you accept these Terms. If you don’t agree, don’t use the Service.
1) Who can use the Service

You must be at least 18 years old, or 13–17 with a parent/guardian’s consent.

You must have the capacity to enter into a contract under applicable law.

You promise that the information you provide is accurate and kept up to date.
2) Accounts and security

You’re responsible for all activity under your account. Keep your login details private and secure.

If you suspect unauthorised use, tell us immediately at support@flyclub.com.

We may refuse, suspend, or terminate accounts to protect users or our Service.
3) What you can expect from us

We provide the Service on an “as is” and “as available” basis. We try to keep things accurate and up, but we don’t guarantee uninterrupted access or error-free content.

We may change, suspend, or stop any part of the Service at any time to improve performance, comply with law, or for maintenance.
4) Your acceptable use
Use the Service responsibly. Don’t:

Break laws or infringe anyone’s rights.

Upload or share anything unlawful, harmful, misleading, defamatory, obscene, or infringing.

Attempt to reverse engineer, scrape, or bypass security or access controls.
-
Interfere with the Service or other users (malware, spam, DDoS, excessive requests).
-
Misrepresent your identity or affiliation.
We can remove content and/or suspend access if these rules are broken.
5) Orders, pricing, and availability (if you shop with us)

Offer and acceptance. Placing an order is an offer to buy. We accept when we dispatch or otherwise confirm the order.

Pricing. Prices are shown in INR unless stated otherwise and include applicable GST where required. If we spot a pricing or availability error, we may cancel the order and refund you in full.

Payment methods. We may accept major cards, UPI, net-banking, and select wallets. By paying, you confirm you’re authorised to use the method and that funds are available.

Fraud checks. We may run verification checks and decline or cancel orders that fail them.

Promos & coupons. Promotional codes apply once per the stated terms, can’t be exchanged for cash, and may have expiry and exclusions.
6) Shipping, delivery, and risk of loss

Processing & delivery windows. Typical dispatch is 1–3 business days; typical delivery is 3–10 business days within India. Remote locations may take longer.

Tracking. We’ll share tracking where available. Delivery times are estimates, not guarantees.

Risk. Risk of loss passes to you on delivery to the address you provide or on pickup, as applicable.

Delivery issues. If a package is marked delivered but you haven’t received it, contact the carrier and us promptly so we can investigate.
7) Returns, exchanges, and refunds

Return window. You may request a return within 7 calendar days of delivery for unused items in original condition with all tags/packaging.

Non-returnables. Final-sale items, perishable goods, gift cards, and items marked non-returnable can’t be returned unless required by law.

Process. Email support@flyclub.com with your order details and reason. If approved, you’ll receive return instructions.

Condition check. We inspect returns on receipt. If the condition isn’t eligible, we’ll notify you and may return the item back to you.

Refunds. Once approved, refunds are issued to the original payment method within 7–10 business days (bank processing times vary).

Exchanges. Subject to stock; otherwise we’ll refund per the above.
Your statutory rights aren’t affected.
8) Subscriptions or memberships (if offered)

If you purchase a recurring plan, it auto-renews at the then-current price until cancelled.

You can cancel anytime from your account before the next billing date to avoid further charges.
-
Trials, if any, convert to paid plans unless cancelled before the trial ends.
-
Fees are non-refundable for partial periods unless required by law.
9) User content

You retain rights to content you post or submit. You grant Fly Club a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your content to operate and improve the Service.

Don’t upload anything you don’t have the rights to share.

We may remove content that violates these Terms or the law.
10) Intellectual property

The Service, including text, graphics, logos, icons, images, software, and other materials, is owned by or licensed to Fly Club and protected by law.

You may not copy, modify, distribute, sell, or lease any part of the Service without written permission.
-
Trademarks identifying Fly Club must not be used without consent.
11) Third-party links and services

We may link to third-party sites or use third-party services. We don’t control them and aren’t responsible for their content, policies, or availability.

If you use a third-party service, their terms and privacy practices apply.
12) Communications from us

By using the Service, you agree we may send you transactional communications (order updates, security alerts, policy changes) via email, SMS, WhatsApp, or phone.

You can opt out of non-essential marketing messages at any time using the unsubscribe or settings options provided.
13) Privacy and cookies

We collect and use personal data to run the Service, process orders, provide support, and meet legal obligations.

We use cookies and similar technologies for core functionality, analytics, and security.

14) Disclaimer of warranties
To the fullest extent permitted by law, the Service and all content, products, and features are provided “as is” and “as available.” We disclaim all warranties—express, implied, or statutory—including merchantability, fitness for a particular purpose, and non-infringement. We don’t guarantee continuous, secure, or error-free access.
15) Limitation of liability
To the fullest extent permitted by law:

We won’t be liable for indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, data, goodwill, or business interruption), even if advised of the possibility.

Our total liability for any claim related to the Service will not exceed the greater of (a) INR 10,000 or (b) the total amount you paid to Fly Club for the transaction giving rise to the claim.
Some jurisdictions don’t allow certain limits; those limits apply only to the extent permitted.
16) Indemnity
You agree to defend, indemnify, and hold harmless Fly Club and our directors, officers, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms or applicable law.
17) Suspension and termination
We may suspend or terminate your access at any time if we believe you’ve violated these Terms, created risk for us or others, or for any reason permitted by law. You may stop using the Service at any time. Certain sections (including IP, disclaimers, limitations, indemnity, and dispute terms) survive termination.
18) Changes to these Terms
We may update these Terms when needed. If we make material changes, we’ll provide reasonable notice (for example, by email or a notice on the site). The updated Terms take effect on the date stated. Continuing to use the Service after changes means you accept the new Terms.
19) Compliance, export, and sanctions
You must comply with all applicable laws, including export controls and sanctions. You may not use the Service if you are located in, or are a national of, a country or region subject to comprehensive sanctions, or if you are on a restricted-party list.
20) Force majeure
We’re not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, labour disputes, power failures, internet outages, or actions of governments.

22) Governing law and dispute resolution

Governing law. These Terms are governed by the laws of India, without regard to conflict-of-laws rules.

Dispute process. First, let’s try to fix things informally. Email support@flyclub.com within 30 days of the issue.

Arbitration. If we can’t resolve it, any dispute, controversy, or claim arising out of or related to these Terms or the Service will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be New Delhi, India. The tribunal will consist of a sole arbitrator appointed in accordance with the Act. The language will be English.

Courts. Subject to the arbitration clause, courts at New Delhi have exclusive jurisdiction for any permitted court proceedings (e.g., to seek interim relief).
Consumer protection rights under applicable law remain available to you.
23) Miscellaneous

No waiver. If we don’t enforce a provision, that doesn’t mean we’ve waived it.

Severability. If any part of these Terms is invalid, the rest remains in effect.

Assignment. You can’t assign your rights or obligations without our consent. We may assign these Terms in connection with a merger, acquisition, or asset transfer.

Entire agreement. These Terms, along with any policies referenced here (like the Privacy Policy and Returns Policy), make up the entire agreement between you and Fly Club regarding the Service.
